This website is operated by Enzo & Rosa Toronto. Throughout the site, the terms “we,” “our,” and “us” refer to Enzo & Rosa Toronto. By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by the following Terms and Conditions (“Terms of Service,” “Terms”).

These Terms apply to all users of the site, including but not limited to visitors, customers, suppliers, and content contributors. Please read these Terms carefully before using our website. If you do not agree to all the Terms, you may not access the website or use any services.

We reserve the right to update or change these Terms at any time by posting updates on this site. It is your responsibility to check this page periodically. Your continued use of the site after changes are posted constitutes your acceptance of those changes.

Our store is hosted by Shopify Inc., which provides us with the e-commerce platform to sell our products and services.

Article 1 – Definitions

  • Withdrawal Period: 14 days to cancel the contract

  • Consumer: Any individual acting for purposes unrelated to business activities

  • Distance Contract: A purchase made through digital means

  • Durable Medium: Any tool that allows information to be stored for future reference

  • Right of Withdrawal: Right to cancel within 14 days without justification

Article 3 – Scope

These Terms apply to all offers, transactions, and agreements between Enzo & Rosa Toronto and the consumer. They are available electronically and may be stored on a durable medium.

Article 4 – Offers

All offers include a detailed description of products, prices, and conditions. Obvious typographical errors are not binding. Import VAT and customs duties are the responsibility of the buyer.

Article 5 – Contract Formation

The contract is concluded upon acceptance of the offer and confirmation by Enzo & Rosa Toronto. Digital transactions are secured. We reserve the right to refuse an order in case of payment-related risks.

Article 6 – Right of Withdrawal

The consumer has 14 days from receipt of the goods to exercise their right of withdrawal. Items must be returned in their original condition and packaging. The request must be made in writing.

Article 7 – Return Costs

Return shipping costs are the responsibility of the customer. Refunds will be issued within 14 days after receipt or proof of return.

Article 8 – Exceptions to the Right of Withdrawal

Certain products cannot be returned, including:

  • Customized or made-to-order items

  • Sealed hygiene products

  • Digital goods once opened

  • Perishable goods or newspapers/magazines

Article 9 – Prices

Prices are fixed during the offer period, except in cases of major fiscal or economic changes. Prices exclude taxes and import duties and may contain typographical errors.

Article 10 – Warranty and Conformity

Products are guaranteed to conform to their description. Any issues must be reported within 14 days. The warranty is void in cases of misuse.

Article 11 – Delivery

Orders are shipped within a maximum of 30 days unless otherwise agreed. If out of stock, an equivalent product may be offered. Risk transfers to the customer upon delivery.

Article 12 – Subscriptions

Automatically renewing contracts can be canceled with one month’s notice. Renewals must be limited and easy for the consumer to terminate.

Article 13 – Payment

Unless otherwise agreed, payment must be made within 7 days after the withdrawal period. Any payment errors must be corrected promptly by the customer.

Article 14 – Complaints

Complaints must be submitted within 7 days of discovering an issue. We commit to responding within 14 days. If no solution is reached, legal mediation may be considered.

Article 15 – Governing Law

All contracts are governed by Dutch law, even for customers residing abroad.
